Lake Chabot Golf Club Constitution and Bylaws

Article 1   The name of the club shall be Lake Chabot Golf Club
Article 2 Object
        1   To organize a golf club whose home shall be LAKE CHABOT GOLF COURSE, OAKLAND, CALIFORNIA.  
        2.  To cooperate with municipal authorities and course officials in improving and protecting the course and clubhouse facilities.
        3   To organize and promote tournaments for the purpose of increasing opportunities, playing golf and creating good fellowship.
Article 3  Membership
        1.  The active Membership shall consist of persons in good amateur standing only, and must be at least eighteen (18) years old.
        2.   The board of directors may grant honorary membership upon which no initiation fee or dues will be required. Such honorary members shall be entitled to the same privileges as active members, except the right to vote and hold offices in the club. 
        3. The regular initiation fee and applicable N.C.G.A. fee shall be determined by and set by the executive board. 

            4. Senior members, shall be any member who has reached his or her 62nd birthday and has been a member for 20 consecutive years or performed club duties. Shall have dues set at $50. Senior members shall retain all privileges of regular membership.     
 Article 4 Dues and payment of it                                                 
        1.   Plan a ($95) Plan B ($75) Senior  Senior Plan A ($70) Junior ($12.50) per annum basis, payable in advance. Deadline for payment is October 1st. Dues become delinquent November 1st. The board of Directors shall meet to screen delinquent members. Board of directors shall have full power to decide further action to be taken regarding delinquent members. A delinquent member will be required to pay the initiation fee and follow the same admittance procedures as a new member.
Article 5  Officers
        1.   The officers of the club shall be President, Vice President, Secretary, Treasurer and Captain; all officers will be elected annually, except captain, by the active membership. The president will appoint the Captain
        2.    In consideration of work entailed in performing the duties of President, Vice-President, Secretary, Treasurer, Captain, Handicap Chairman and the Editor of 'Hooks and Slices' those holding these offices will be exempt from annual dues for the duration of their time in office.
 
Article 6 Board of Directors
        1.  The club shall be governed by a board of directors consisting of eight  (8) elected Directors whose term of office shall be for a period of two (2) years.  They will hold office until their successors are elected.   When more than four nominations are received, The four nominees receiving the highest number of votes shall be elected Directors. President, Vice-President Secretary, Treasurer will serve as ex-officio members of the Board and be entitled to full voting powers.  The exiting president will automatically become a board member for one year and will serve in an advisory capacity with non-voting powers. 
        2.    In consideration of duties performed as board of directors all board members shall be refunded their annual dues after fulfilling their basic attendance requirement of 9 of 12 of the monthly meeting scheduled.  The board will be the sole judge of excused absences.  
 

   

 

 

Article 7 Duties of officers and board of directors
         1     The President of the club shall preside at all meetings of club members and at all meetings of the   board of directors.  He has the authority to perform such duties as usually develop upon the executive    officer of similar social organizations. 
        2.     The Vice-President shall perform the duties of the President during his absence or disability, or upon his request, and shall assist the President in such manner as is requested.  The vice-President will act as membership chairperson.  
        3.      It is the Secretary's duty to keep a record of the names, addresses, and membership status and send a notice of all general meetings to all active members.  
        4.       The Treasurer shall have charge of all the club funds. The collection of dues, and disbursement of funds. Disbursement of funds is subject to the approval of the President. The Treasurer shall present a financial report at the annual meeting of the membership, and shall be required by the president to make a summary report at each Board of Director meeting.  
        5.        As compensation for the work done by the Secretary and Treasurer, Editor of Hooks and Slices, Handicap chairperson and team Captain will receive 5% of all dues collected for the current year.  
        6.        The Captain shall take charge of all tournaments and perform such duties as may be directed by the President. 
        7.       The board of Directors has general supervision over the affairs of the club.  It is their responsibility to make rules and regulations that govern the club. 
        8.      The President is empowered to spend club funds in an amount not to exceed one hundred ($100/00) for a single expenditure without the approval of the board.  All expenditures exceeding one hundred ($100.00) shall be approved by quorum of the Board Of Directors.  
        9.       The Officers and directors shall be required to attend 9 of 12 monthly meetings.  
        10.     Paid Officers who do not fulfill the basic monthly requirement shall have their annual fees adjusted by the board. 
Article 8 Club meeting
         1.  The annual meeting for the election of Officers shall be held on a date and a place to be designated by the board but not later than the fifteenth of December of each year. All active members are to be notified by mail at least two weeks in advance of the time and place of the meeting. Fifteen members shall constitute a quorum for transacting business. 
        2.     Special club meetings; The President, at his discretion, shall have the power to call a special meeting at any time, and is required to do so upon written request of twenty-five (25) club members. Two weeks notice of such a meeting will be given, by mail as well as the reason for it, The only business at such a meeting shall be that for which it was called.  Twenty-five  (25) active members will constitute a quorum.
Article 9  Board of Director Meetings
         1.       The President may call Board meetings at any time, and must do so upon written request of at least three (3) Directors, Five (5) days written or verbal notice must be given to each Board Member. A quorum consists of five (5) Members of the Board. There shall be at least one (1) board meeting a month.
Article 10   Applications for membership
        1.Applicatuons for membership must be signed by the applicant and endorsed by one active member or by a member of the professional staff and accompanied by the appropriate amount of initiation fees and dues. All applications will be reviewed by the Vice-President and acted upon by the Board of Directors.

 

Article 11 Suspension and expulsion of members
        The  Board of Directors, by a majority vote, may suspend or expel any club  member at any time for violation of the clubs bylaws or for unsportsperson  like conduct, or for action prejudicial to the best interests of the club, provided the offending member be given notice and opportunity to be heard, in person, before the board.
 Article 12 Handicap Committee
        1.Board of Directors may designate itself the handicap committee, or may request the President to appoint a separate committee of which the Captain will be an ex-officio member. 
Article 13 General Committees
        1. The President is invested with full authority to appoint, from time to time such committees as he deems necessary to accomplish his purposes, such committees shall have a Chairperson. Appointed by the President at the time of appointing the committee. All committees so appointed are to report to the President, unless instructed otherwise. 
Article 14 Vacancies-Officers or Directors
         Any vacancies occurring in the clubs elected officers or Board of Directors  shall be filled by election by the board of directors.  Such election to be for the unfilled      portion of the term only.
 Article 15  Annual Audit of records   
         1.        At the end of each year and after the annual election of officers and directors, The President shall appoint a committee of three members to audit all of the clubs records for the current year. The audit will be submitted by the Chairperson of the committee as a report at the following meeting. If approved by the members at such a meeting, It will become a part of the permanent club record with the formal approval and ratification of the Officers and Directors for the period covered by the audit report. 
         2.The Treasurer will assist the auditing committee in their audit.  He will produce all of his financial records of receipt and disbursements when so requested. The record of all membership meetings both regular and special and of all Board Of Directors meetings will be open to the auditing committee when requested. 
Article 16 Holding Office
        No member of the club shall be permitted to hold two (2) offices of the club  in the same year, either elective or appointed.
 Article 17 Amendments
        Amendments may be made by a majority vote of the Board Of Directors. Such amendments will have full force and effect pending their submission to the club members at the regular or special meeting called for that purpose and if such are not then approved by the majority vote of the active members present, They shall have no further effect.
Article 18  Junior membership, College Students, Military Personnel
        1.         Junior members in good standing shall pay $12:00 dues.. A junior member is defined as any individual who has not yet reached their eighteenth birthday. After their eighteenth birthday, the individual is eligible to be initiated in the golf club and only pay current annual dues. The Club shall waive the initiation fee. Junior members may participate in club tournaments, but are not eligible for tournament prizes. 
         2.         College Students who are post junior members in good standing , Pay N.C.G.A. dues plus $6.50 As long as they maintain current full time student status.
 Section      (1) and (2) shall also apply to military personnel.
Article 19 Tournament Rules
        1.Any member who registers, then withdraws from any such tournament must communicate his withdraw directly to the captain at least forty eight (48) hours prior to the date of the tournament.
        2.Any player who fails to appear for a tournament round shall be assessed the green fee and
the starting time
